Arthritis Foundation Winter Wellness Sweepstakes Official Rules 

NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR TO WIN OR CLAIM A PRIZE. A PURCHASE, PAYMENT OR DONATION WILL NOT INCREASE YOUR CHANCE OF WINNING.

This Sweepstakes is sponsored solely by the Arthritis Foundation, with an address at 1355 Peachtree St NE Suite 600, Atlanta, GA 30309 (“Sponsor”).

1. Eligibility. The Sweepstakes is open only to individuals who are residents of any of the 50 states of the United States or the District of Columbia and who are 18 years of age or older at the time of a valid entry. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law. Employees of the Arthritis Foundation, its suppliers, vendors and agents as well as their immediate family members, or those residing in the same household are not eligible to participate in the Sweepstakes or win a prize. Only one valid entry per email address per the duration of the Sweepstakes. Additional entries will be deleted before any winners are selected. 
   
   
2. Timing. The Sweepstakes begins on December 10th, 2021 at 5:00 p.m. EST. and ends on January 4th, 2022 at 10:00 a.m. EST. The Sponsor’s computer is the official timekeeping device for this Sweepstakes. 
   
   
3. How to Enter. The Sweepstakes has two valid forms for entry.  Entries must be entered via the Facebook lead ad associated with the sponsored ad campaign for this Sweepstakes or by completing the form located at https://info.arthritis.org/winter-wellness-sweepstakes. A valid entry must consist of a valid email address by which the entrant may be contacted if selected as a winner. Entries without a valid email address or that do not adhere to the rules or specifications of the Sweepstakes may be disqualified at the sole decision of the Sponsor. If you use fraudulent methods for entry, your entry may be disqualified at the sole discretion of the Sponsor. 
   
   
4. Prizes. The winners of the Sweepstakes will receive the following prizes. The first randomly selected winner from all valid entries will receive a 2021 iPad, Wi-Fi enabled with 256 GB storage valued at an approximate retail value $479.00. The second and third randomly selected winner from all valid entries each will receive a 2021 Series 7 Apple Watch valued at $399.00. Actual/appraised value of prizes may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution shall be permitted except at the Sponsor's discretion. Sponsor may award the prize as an Apple gift card in the amount of the retail value. The prize is nontransferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by any winner is not permitted. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of each winner.  Each winner hereby consents to release of his or her name and contact information in connection with any requirement of Sponsor to identify Sweepstakes winners.  
   
   
5. Odds of Winning. The odds of winning are dependent on the number of eligible entries received.
   
   
6. Winner Selection and Notification. The winners will be selected by a random draw conducted under the supervision of the Sponsor. The winner will be notified within 7 days after selection. The Sponsor shall have no liability for any winner's failure to receive notice due to spam, junk e-mail or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information. If the winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate winner selected. Receipt of any prize offered in this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these official rules by any winner at the Sponsor's sole discretion will result in disqualification, and all rights and entitlements to any prize will be immediately terminated. 
   
   
7. Terms and Conditions. The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should a virus, bug, non-authorized human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, the Sponsor may select winners from eligible entries received before and/or after the action taken by the Sponsor if appropriate. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Official Rules. The Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law. 
   
   
8. Limitations of Liability. By entering the Sweepstakes you agree to release and hold harmless Arthritis Foundation and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Sweepstakes and/or acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorized intervention in any part of the Sweepstakes; (iii) electronic or human error in the administration of the Sweepstakes or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.
    
9. Disputes. This Sweepstakes is governed by the laws of United States, without respect to conflict of law doctrines. By participating in the Sweepstakes, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with it, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Atlanta, Georgia having jurisdiction. Further, in any such dispute, under no circumstances shall you be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than your actual out-of-pocket costs associated with entering the Sweepstakes. You further waive all rights to have damages multiplied or increased.   
   
   
10. List of Winners.  To obtain a list of winners, please send a self-addressed stamped envelope to Sponsor at the address identified above, attention: Sweepstakes information requested, and ask for a list of winners. 
    
    
11. Privacy Terms.  Sponsor will collect personal data from entrants when they enter the Sweepstakes, and this information will be used for the purposes of administering the Sweepstakes and, unless prohibited by entrant upon entry into the Sweepstakes, other promotional purposes that benefit Sponsor.  Information submitted with an entry is subject to the Privacy Policy posted on the Arthritis Foundation Website. 12. Facebook. The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook.
    
    
13. Severability.  If any provision of these Official Rules is held by a court of competent jurisdiction to be invalid or unenforceable, all remaining provisions will remain in full force and effect.
